Participation in competitions and/or social media competitions of LANIUS GmbH (hereinafter referred to as "LANIUS") is only possible if these conditions of participation are taken into account. The organizer of the competition is LANIUS GmbH. The competition is independent of Instagram.
1. Requirements for participation
The LANIUS x The Colorful Crew competition runs from March 9th, 2025 to March 11th, 2025 until 11:59 p.m. on Instagram. Participation is possible by following the specified accounts and leaving a comment under the respective competition post.
Participation must take place within the specified period; receipt of the participation by LANIUS is decisive. LANIUS cannot be held responsible for technical faults/delays. All natural and legally competent persons aged 18 and over are eligible to participate, with the exception of LANIUS employees and their relatives and employees of LANIUS cooperation partners. Each participating person may only take part in the competition once and can only win once. Participation via competition agencies, automated services or other service providers is not permitted. Also excluded are persons who use unauthorized aids, otherwise gain advantages through manipulation or whose personal details are not true when registering. In these cases, prizes may also be revoked and reclaimed retrospectively. Only self-created photographs may be submitted for photo competitions. Images created by third parties as well as lewd or defamatory images will be excluded from participation and deleted. In the case of social media competitions, the promotion has no connection with Facebook or Instagram and is not sponsored, supported or organized by Facebook or Instagram in any way. The recipient of the information you provide is not Facebook or Instagram, but LANIUS. The information provided is provided solely for the entertainment of our Instagram followers. LANIUS reserves the right to change this data without giving reasons and to cancel the competition early. The prize will be awarded as advertised in the competition. Cash payment of the prize value and exchange or transfer of the prize are excluded. If the winner cannot claim the prize (e.g. due to the passage of time), it will be forfeited without replacement. Legal recourse is excluded. The winners will be notified in writing, by email or on the social media platform used for the competition. Any costs incurred by the winner in and/or through the use of the prize are only included if this was expressly stated in the competition. Each participant is responsible for the accuracy of their contact details.
2. Organizer
The competition is organized by LANIUS. Participation in this competition is free of charge and independent of the purchase of goods or services. The normal internet fees and other connection costs incurred during participation in the competition are to be borne by the participant.
3. Early termination of the competition
LANIUS reserves the right to cancel or terminate the competition in whole or in part at any time without prior notice and without giving reasons. Until the prize is handed over, LANIUS also expressly reserves the right to change the course of the game and/or to change the type and scope of the prizes, exchange them and replace them with another prize without notice or giving reasons. This applies in particular if the draw cannot go ahead as planned, e.g. due to disruptions caused by computer viruses, software and/or hardware errors and/or other technical/legal reasons which do not guarantee the proper conduct of the competition. In this case, the participants have no claims against LANIUS.
4. Storage of personal data for the duration of the competition
If it is necessary to determine the winner, the email address of all participants will be saved during the competition period. The data will be saved solely for the purpose of conducting the competition and determining the winner. In that case, all participants will then receive an email from LANIUS informing them of the outcome of the competition. By registering, the participant expressly agrees to the storage and use of the personal data provided for the purpose of conducting the competition. The data will be deleted after the competition has ended. If a participant would like their data to be deleted before the end of the competition, they can inform LANIUS of this at any time by email. In this case, participation in the draw is no longer possible.
If you take part in one of our competitions (for example by commenting on or liking a post) that we run on our site, we will use your data to determine the winner and contact them via private message. We will only use the other data that the winner sends us to send the prize. All personal data of the participants, with the exception of the winner's data, will be deleted after the competition has ended. The winners' data will be deleted after the statutory retention periods have expired. The legal basis for the processing of your personal data in the context of a competition is Art. 6 (1) b) GDPR.
5. Liability
LANIUS is only liable for intent and gross negligence. Liability for simple (minor) negligence is excluded; this does not apply to the violation of essential contractual obligations (cardinal obligations) or to life, body and health. The above limitation of liability applies in particular to damage caused by errors, delays and interruptions in the transmission of data, malfunctions in technical systems, loss or deletion of data. In particular, LANIUS does not guarantee that the competition can be accessed at any time and is error-free. LANIUS is not liable for material or legal defects in the prizes. Warranty claims with regard to the prizes are excluded against LANIUS.
6. Miscellaneous
Should one or more provisions of these terms and conditions of participation be invalid and/or unenforceable in whole or in part, this shall not affect the validity and/or enforceability of all other provisions. The invalid and/or unenforceable provision shall be deemed to be replaced by the valid and/or enforceable provision that comes closest to the economic purpose pursued by the parties. The same applies to the filling of any gaps in the contract. By participating, the user accepts these terms and conditions of participation.
